LITTLE VALLEY—A Cattaraugus County grand jury Thursday voted not to indict two teens of rape charges involving a 17-year old Salamanca girl last December.

Charges of first-and third-degree rape and third-degree assault were considered against Joshua Kinder, 18, of East Otto, and Shane Gogel, 18, of Salamanca, for an incident Dec. 9 at Hillview Homes in Salamanca. The two admitted to Salamanca city police they had consensual sex with the girl and were indicted on rape charges Feb. 19 by a grand jury.

In June, County Judge Larry M. Himelein dismissed that indictment obtained by former Assistant District Attorney Lori Rieman, ruling it was illegal, and ordered the two men released after being in jail six months.

Himelein granted the district attorney’s office the opportunity to again present the case. On Thursday, Kinder and Gogel, each with his attorney present, testified before the grand jury.
