Buffalo man gets five years for 2004 homicide

Corey Cox will spend at least another five years in prison for fatally shooting a man during an attempted stickup six years ago.
State Supreme Court Justice Shirley Troutman imposed a prison term of 3-1/3 to 10 years today on Cox's March 18 conviction on a first-degree manslaughter charges for the July 25, 2004 homicide outside a Genesee Street bar.
Cox, 21, recently completed a five-year sentence on another armed crime, but he has remained held since he was arrested last year on murder charges for gunning down Robert B. Kowalewski. Because he was only 15 when he killed Kowalewski, he likely will spend only about five more years behind bars, his lawyer, Anthony J. Lana confirmed.
A jury also found Cox guilty of attempted robbery, but because of the mandates of state criminal law involving criminals younger than 16, the judge had to dismiss that conviction.
Cox apologized in court to Kowalewski's widow, Jennifer, and said the fatal shooting was "unintentional."
Trial prosecutors Lawrence M. Schwegler and Paul C. Parisi were openly skeptical about the sincerity of Cox's apology, telling the judge that he just completed a five year term for an armed robbery he committed four months after he gunned down Kowalewski.
