Christopher Smith wants to sell cars on Sheridan Drive.

He'll have to wait.

The Clarence Town Board, at a public hearing Wednesday night, voted to send Smith's request

for a car lot at 8137 Sheridan back to the Planning Department. A temporary conditional

permit, allowing the Clarence Center resident to house his operator's license at the Sheridan

location, was granted.

The permit, which does not allow the display or storage of vehicles, will run for one year.

"I would move to send this to our planning board for their review," said Councilman

Bernard Kolber. "If you need a place to hang your sign, that I wouldn't mind approving."

A town resident, living at 8131 Sheridan, expressed his opposition.

"They've been running a car lot out of there for about a year now," he said. "Cars are in

and out of there, all the time. I really don't feel this is the place for a car lot.

"Our area's pretty much residential. I don't think that any more traffic is necessary."

The resident also said that as many as 15 cars were recently on the property.

Smith, when pressed by Clarence Town Supervisor Scott A. Bylewski, denied this.

"I have not had any cars there," he said. "I can't imagine there being 15 cars there. I

understand there's an ongoing dispute between the neighbors. There's no activity there at

all."

"The sign is there, but you're saying there are no cars there?" Kolber asked.

According to Smith, the sign was necessary to meet Departyment of Motor Vehicles licensing

standards. Board members were also concerned about the proposed lot's surface.

"Right now, what is it ... paved, stone?" Kolber asked.

Smith advised that cars, at least at the beginning, would be parked on stone.

"If things go well, I'll pave it," he said. "I'd hate to agree to do it, and find out that

people don't want to look at cars there."

Councilman Patrick Casilio asked planning representatives to determine what kind of surface

is mandated.

"I'd like to see a clarification about the paving," Casilio said.
