Newstead woman charged under new Leandra's Law
Updated: August 21, 2010, 9:38 AM
A Newstead woman arrested Tuesday evening for driving while ability impaired by drugs now faces three felony charges, one for driving in that condition with her 6-month-old son in the car, Erie County sheriff's officials reported.
Deputy Brandon Stott stopped a vehicle for going through a red light and failing to stay in its lane on Main Road in Newstead at about 6:35 p.m. Tuesday. Stott and Deputy Daryl DeMari determined that the driver, Julie A. Haas, 27, of Rapids Road, was driving under the influence of drugs.
The initial charge of driving while ability impaired by drugs was upgraded to a felony, after computer records revealed that Haas had a DWI conviction last April in the Town of Alden, sheriff's officials said. She also was charged with felony aggravated unlicensed operation, because her license had been revoked in April.
And because her young son was in the vehicle, Haas was charged under New York State's new Leandra's Law - aggravated DWI with a child - another felony, authorities said. The baby was turned over to the care of a grandparent.
