Woman pleads not guilty in DWI crash hurting child
Updated: August 21, 2010, 4:23 AM
Tamara Sloan was allowed to remain free without bail after pleading not guilty Thursday to an indictment charging her with aggravated drunken driving with children and child endangerment for the two-car crash in which her 7-year-old daughter suffered a broken ankle.
State Supreme Court Justice M. William Boller ordered Sloan, 35, of University Avenue, Town of Tonawanda, to continue the alcoholism counseling she started after the Dec. 27 crash at North Bailey Avenue and Sheridan Drive in Amherst. Prosecutor Kelley A. Omel had sought $5,000 bail.
Omel said Sloan was northbound on Bailey when she is accused of veering into the southbound lane and crashing into an oncoming car. Sloan had a 0.22 blood-alcohol content— nearly three times the legal limit—according to the prosecutor. Her 2-year-old son also was in the car.
Under the state’s new Leandra’s Law, a first-time alcohol-related driving offense with children under 16 in the vehicle is treated as a felony, carrying penalties ranging from probation up to 25 years in prison if a child is injured or killed.
