LOCKPORT—Niagara County Judge Matthew J. Murphy III said Friday the prosecutor’s recommendation was a key factor in his decision to sentence a drunken driver to six months in the county jail instead of up to four years in prison.

“Another judge might not be so lenient,” Murphy warned Paul D. Frontuto, 40, of Oliver Street, North Tonawanda. “You just can’t drink alcohol. It’ll just get you in trouble.”

Frontuto pleaded guilty to a felony count of driving while intoxicated Oct. 9, when Deputy District Attorney Theodore A. Brenner recommended no more than six months’ incarceration. Frontuto was arrested June 5 in North Tonawanda.
