Felony DWI charges pending after crash
A Concord man faces felony driving while intoxicated charges following a crash at about 6 a. m. Tuesday on Route 39 in Springville, Erie County sheriff’s officials said.
Martin Swartzmiller, 44, of Old Glenwood Road, was arrested by Deputy Nathan Bork after Swartzmiller drove his vehicle into a ditch, deputies said.
Swartzmiller, who was convicted of driving while intoxicated in Cheektowaga in 2007, refused to take a breath test, deputies said, and was taken to the Erie County Holding Center pending arraignment.
