Lawyers for ex-mayor seek dismissal of case
The lawyers representing former East Aurora Mayor David J. DiPietro insisted Friday that a violation charged against him by a former political ally lacks merit and they will seek to have the case dismissed.
DiPietro pleaded not guilty Thursday before Wales Town Justice Raymond Poliseno to one count of second-degree harassment for allegedly cursing Anne
M. Leary on April 7 on his last day in office as mayor when she came to Village Hall to pay her water bill.
Leary has pressed charges, and motions will be heard in court July 24.
“There’s no violation of the law here,” said his attorney, Patrick Quinlivan. “We don’t see any basis in law or facts for it. We believe the matter is politically motivated.”
