Man sentenced to up to 7 years on DWI conviction, fined $2,500

LITTLE VALLEY — A Portville man was sentenced Monday in Cattaraugus County Court to serve up to seven years in prison for driving while intoxicated last year on I-86 in the Town of Randolph.

Geoffrey A. Cullinan, 28, was sentenced by Judge Larry M. Himelein to serve 2x to seven years and fines of $2,500 for his convictions of DWI and driving without a license Nov. 2. He will serve a concurrent six-month sentence for driving without a license.

In another case, Dawn L. Dutton, 40, of Portville, was sentenced to one year in the county jail for her conviction of third-degree rape between July and August 2008 in the Town of Hinsdale involving a person under age 17.

Marc D. Swiech, 40, of the Town of Boston, was sentenced to five years’ probation and fined $5,000 for his conviction on DWI charges and must attend 12 months of DWI court. He was fined $1,000 for driving without a license. Both violations occurred July 4, 2008, in the City of Salamanca.

Ronald J. Minich, 27, of Bradford, Pa., was sentenced to five years’ probation, including 200 hours of community service, for his conviction of thirddegree attempted burglary. He must also serve a concurrent three-year probation sentence for his conviction of petit larceny. The incident occurred July 27, 2008, at a building owned by Synergy Oil Co. in the Town of Carrollton.

District Attorney Edward M. Sharkey said several others pleaded guilty and will be sentenced in November.

Terry G. Brown, 20, of Machias, pleaded guilty to thirddegree attempted burglary and petit larceny May 29 at a building in the Town of Machias.

Joshua W. John, 28, of Randolph, pleaded guilty to DWI March 19 in the Town of Coldspring for driving with a blood-alcohol content of 0.22 percent, nearly three times the legal limit.

Jamie L. Kirtz, 25, of Olean, pleaded guilty to DWI and driving without a license Feb. 22 in the City of Olean with a blood-alcohol count of 0.27 percent, more than three times the legal limit.

Mark W. Gilman 42, of Great Valley, now in the county jail, pleaded guilty to third-degree burglary between Nov. 24, 2007, and Dec. 31, 2007, at a building in the Town of Franklinville.

Nicholas S. Powley, 24, of Olean, pleaded guilty to DWI July 4 in the City of Olean.

Bradley I. Kyler, 21, of Salamanca, pleaded guilty to two counts of third-degree criminal sale of a controlled substance Jan. 30, 2008, in the Town of Salamanca and Feb. 1, 2008, in the City of Salamanca involving cocaine sales. Sentencing is set for Jan. 4.
