Yorkshire burglary brings prison term

LITTLE VALLEY — An Olean man faces up to three years in prison for a burglary last year. Thomas J. Smith, 30, now in the county jail, was sentenced Monday by Cattaraugus County Judge Larry M. Himelein to serve from one to three years in prison.

Smith is also to pay restitution after pleading guilty to third-degree attempted burglary June 7 at a seasonal home on Dublin Terrace in the Town of Yorkshire.

In another sentencing, Harry R. Little, 45, of Allegany, was sentenced to five years’ probation and $2,500 in fines for his convictions of driving while intoxicated and without a license Sept. 28, 2007, in the City of Salamanca.

District Attorney Edward M. Sharkey said several others entered guilty pleas.

• Briet K. Boykin, 37, of Olean, pleaded guilty to third-degree criminal possession of a controlled substance, cocaine, April 5 in the City of Olean. She faces sentencing May 18.

• Willester York, 46, of Olean, pleaded guilty to fifth-degree attempted criminal possession of a controlled substance, crack cocaine, June 1, 2007, in the City of Olean. Sentencing is set for April 6.

•John T. Johnston, 32, of Bradford, Pa., pleaded guilty to third-degree attempted burglary July 27 at a building in the Town of Carrollton. May 18 was set for his sentencing.

• Billy Coleman, 19, of Olean, pleaded guilty ton fifth-degree criminal sale of a controlled substance, crack cocaine, April 12, 2007, in the City of Olean. He will be sentenced May 11. Coleman entered his plea after one day of a trial.

The case for Mark D. Swiech, 40, of Boston, was adjourned for further motions after he pleaded not guilty to DWI and driving without a license July 4 in the City of Salamanca.
