Franklinville drug sale brings 4-year term in prison

LITTLE VALLEY — A Humphrey man who sold drugs in Franklinville was sentenced Monday in Cattaraugus County Court to four years in prison.

Steven A. Atkinson, 48, now in the county jail, was sentenced as a repeat felon by Judge Larry M. Himelein for his conviction of fourth-degree criminal sale of a controlled substance, dihydrocodone, Sept. 21, 2007.

Atkinson also faces two years of supervision when he gets out of prison.

In another sentencing, Frank P. O’Dell, 25, of Delevan , now in the county jail, was sentenced to three years in prison for his conviction of first-degree sexual abuse of a person under age 11 during August in the Town of Yorkshire.

O’Dell was also sentenced to five years of supervision when released from prison.

Kenneth A. Davis, 40, of Florida, now in the county jail, was sentenced to two years in prison for his conviction of second-degree attempted robbery. He was further sentenced to two concurrent one-year terms for his convictions of fourth-degree criminal possession of stolen property and third-degree unlawful fleeing a police officer.

Davis also faces two years of supervision after serving his sentence for the incident July 14 at a house in the Town of Farmersville.

Joseph W. Shelton, 48, of Salamanca, was sentenced to one to three years in prison and fined $5,000 for his conviction for driving while intoxicated Feb. 26 in the City of Salamanca.

Joshua D. Kritz, 20, of West Seneca, was sentenced to five years’ probation, including 100 hours of community service, and is to pay $1,000 restitution for his conviction of third-degree burglary Nov. 4, 2007, at Lambert’s Storage in the Town of Machias.

District Attorney Edward M. Sharkey said three others were sentenced for their convictions of DWI.

Heather L. Deer, 25, of Franklinville, was sentenced to two concurrent five-year probation terms and $4,000 in fines for her convictions of DWI and driving without a license Sept. 7, 2006, and Feb. 5, 2007, in Franklinville.

Lewis R. Hicks, 55, of Salamanca, was sentenced to five years’ probation and fined $2,500 for his conviction of DWI Nov. 25, 2007, in the City of Salamanca.

Kevin E. Crandall, 24, of Olean, was sentenced to five years’ probation and fined $2,000 for his conviction of DWI on Aug. 12, 2007, in the Town of Portville.
