Driver indicted in wife’s death

LITTLE VALLEY — A Cattaraugus County grand jury on Thursday reported six open indictments, including the case of a Bradford, Pa., man charged with vehicular manslaughter in the death of his wife. All will be arraigned later this month.

Lanny C. Holly, 56, of Bradford, Pa., was indicted on charges of second-degree manslaughter, second-degree vehicular manslaughter, criminally negligent homicide and driving while intoxicated.

District Attorney Edward M. Sharkey said the charges are connected to an accident Nov. 9 on Route 219 in the Town of Carrollton, where Holly’s vehicle went off the road, dragging a guide rail, striking a tree and bursting into flames. Holly managed to climb out of the vehicle to safety, but his wife, Carol D. Holly, 53, of Rixford, Pa., died.

Sharkey said the couple was returning from the Seneca Allegany Casino in Salamanca. Holly also faces charges of driving with a blood-alcohol count of 0.11 percent, higher than the legal limit.

James R. Olson 24, of Randolph, currently in the county jail, was indicted on charges of third-degree burglary, two counts of second-degree burglary, first-degree identity theft, fourth-degree grand larceny and three counts of petit larceny.

Sharkey said that between Feb. 1 and Dec. 3, 2007, in the Town of Randolph, Olson represented himself as another person to obtain money, credit or services over $2,000.

Also, Sharkey said, in January and February, in the Town of Coldspring, Olson entered two dwellings, stealing firearms from one of them.

On Feb. 2, Sharkey added, Olson illegally entered a building in the Town of South Valley.

Garth VanEvery, 34, of Irving was indicted on charges of DWI, driving without a license and several traffic violations April 13 in the City of Salamanca, where he was driving with a blood-alcohol count of 0.23 percent, nearly three times the legal limit.

Jeremy A. Preston, 18, of Freedom was indicted on charges of second-degree burglary and second-degree criminal mischief. The alleged crime occurred March 7 in a Town of Freedom building that received $1,500 in damages.

John F. Bean, 26, of Olean was indicted on second-degree assault charges in a Feb. 2 incident in Olean in which another man was seriously injured.

David D. Tester, 28, and Kenneth A. Davis, 39, both of Florida and currently in the county jail, were jointly indicted on charges of second-degree burglary, third-degree burglary, third-degree criminal possession of stolen property and third-degree unlawfully fleeing a police officer.

Sharkey said that on July 14 the men broke into a Town of Farmersville house. A chase followed.
