Sentencing dates set in guilty plea cases

LITTLE VALLEY — Sentencing dates in several cases where guilty pleas have been made were set for September in Cattaraugus County Court before Judge Larry

M. Himelein. District Attorney Edward M. Sharkey said each of the defendants entered pleas earlier this week.

Ryan S. Bartlett, 26, of Salamanca, now in the county jail, pleaded guilty to thirddegree rape and endangering the welfare of a child after being charged with having sex with a person under age 17 on March 14 in the Town of Allegany.

Cassandra L. Busekist, 27, of Salamanca pleaded guilty to third-degree criminal possession of a controlled substance after being arrested Dec. 19 in the City of Salamanca with crack cocaine intended for sale.

Eugene Cabral Jr., 45, of Rhode Island pleaded guilty to attempt to evade or defeat cigarette tax. He was arrested May 11 in the City of Salamanca while transporting unstamped packages of cigarettes. He was sentenced to a one-year conditional discharge.

Michael J. Buncy, 44, of Delevan pleaded guilty to driving while intoxicated. He was arrested Aug. 4 in the Town of Franklinville for driving with a blood alcohol count of 0.15 percent.

Devon M. Grochowiak, 18, of West Seneca pleaded guilty to third-degree attempted burglary in connection with a Nov. 4 incident at Lambert’s Storage in the Town of Machias.

Kathleen E. Jimerson, 34, of Davenport, Fla., pleaded guilty to driving while intoxicated. She was arrested July 23 in the City of Salamanca when she was driving with a blood alcohol count of 0.21 percent.

Martie L. Oakes, 26, of Franklinville, now in the county jail, pleaded guilty to DWI and driving without a license. He was stopped April 25 and found to have a blood alcohol count of 0.19 percent.

Brandon D. Carroll, 17, of Gowanda pleaded guilty to fifth-degree criminal possession of a controlled substance. He was arrested April 11 in the Town of Persia.

Sharkey said that in other cases, several defendants were arraigned and entered not guilty pleas. Their cases were adjourned for further motions.

David L. Maull, 46, of Olean pleaded not guilty to an indictment charging him with third-degree criminal sale of a controlled substance and third-degree criminal possession of a controlled substance June 15, 2006, in the City of Olean involving the sale of crack cocaine.

David A. Foster, 52, of Olean, now in the county jail, pleaded not guilty to thirddegree criminal sale of a controlled substance and third-degree criminal possession of a controlled substance involving the sale of crack cocaine.

Leslie R. John, 23, of Salamanca pleaded not guilty to third-degree criminal sale of a controlled substance and second-degree criminal possession of a controlled substance. He was arrested on Dec. 7 in the City of Salamanca with more than four ounces of a narcotic drug intended for sale.

Mark A. Larrabee, 27, of Great Valley and Charles E. Miller II, 19, of Olean, each pleaded not guilty to third-degree burglary and fourth-degree grand larceny involving a December break-in at Buffalo Crushed Stone in the Town of Machias when property valued at more than $1,000 was stolen.
