Ricky Armstrong Jr. sentenced to up to nine years in prison

LITTLE VALLEY— Ricky L. Armstrong Jr., 19, of Salamanca, son of a former Seneca Nation of Indians president, faces up to nine years in prison following sentencing in Cattaraugus County Court on assault and burglary charges.

Armstrong was sentenced by Judge Larry M. Himelein to serve from two to six years in prison for his conviction of third-degree burglary of a building June 1, 2007, in the Town of Little Valley.

District Attorney Edward M. Sharkey said Armstrong, who’s been held in the county jail, also was sentenced to serve one to three years in prison for his conviction of second-degree attempted assault Dec. 1 in the City of Olean, when he injured another man. Sharkey said the two sentences are to be served consecutively and total three to nine years.

Other sentences handed down by Himelein included:

Timothy M. Waterman, 21, of Cuba, presently in the county jail, was sentenced as a repeat felon to serve 1z to three years in prison for his conviction of third-degree attempted burglary at a building Dec. 16 in the Town of Hinsdale.

Also, Waterman was sentenced to serve a consecutive term of one to three years in prison for his conviction of probation violation, making his total sentences 2z to six years.

Wyatt E. Woodard, 19, of Gowanda, now in the county jail, was sentenced to one to three years in prison for his convictions of third-degree attempted burglary and fourth-degree criminal mischief at a building Dec. 20 in the Town of Persia when the property was intentionally damaged.

Wilbur L. Fountain Jr., 32, of Olean, held in the county jail, was sentenced as a repeat felon to serve 1z to three years in prison for his conviction of second- degree escape Sept. 18 in the City of Olean after being arrested for probation violation, when he escaped from police custody,

Sharkey said Fountain was also sentenced to serve a concurrent sentence of one year in the county jail for violating a previously imposed probation sentence by escaping.

Jarrod I. Lingle, 24, of Machias, was sentenced to serve from one to three years in prison and fined $2,000 for his conviction of driving while intoxicated June 2, 2007, in the Town of Machias while driving with a blood alcohol count of .10 percent.

Suzette L. Pietras, 42, of New Albion, was sentenced to serve four months of weekends in the county jail, five years’ probation and fined $2,500 for her conviction of DWI and driving without a license April 25, 2007, in the Town of New Albion.

Kurt J. Kozlowski, 19, of Fillmore, was sentenced to 60 days in the county jail, five years’ probation and fined $3,500 for his conviction of DWI Nov. 23 in the Village of Ellicottville when he was driving with a blood alcohol level of .18 percent.

Christopher J. Dixon, 33, of Limestone, was sentenced to five years’ probation including 100 hours of community service and fined $2,500 for his conviction of DWI Dec. 21 in the Town of Franklinville when he had a blood alcohol count of .18 percent.

Dustin B. Goss, 20, of Ellicottville, was sentenced to five years’ probation including 100 hours of community service and restitution for his conviction of third-degree attempted burglary Dec. 28 at Buffalo Crushed Stone in the Town of Machias.

Jack L. Borden Jr., 40, of Cuba, was sentenced to 90 days in jail, five years’ probation and fined $2,000 for his conviction of DWI Jan. 13 in the City of Olean, when he was driving while he had a blood alcohol count of .23 percent, nearly three times the legal limit.

Rene J. Collett, 35, of Hamburg, was sentenced to five years’ probation including 200 hours of community service and fined $2,000 for her conviction of DWI and driving without a license Jan. 7 in the Town of Yorkshire with a blood alcohol count of .16 percent.

Michelle L. Prentice, 45, of Olean, was sentenced to 10 days in the county jail, five years’ probation including 100 hours of community service and fined $2,500 for her conviction of DWI June 16, 2007, in the Town of Allegany when she was driving while she had a blood alcohol count of .15 percent.

Joseph G. Latona, 75, of West Valley, was sentenced to five years’ probation including 200 hours of community service and fined $2,500 for his conviction of DWI Jan. 25 in the Town of Ashford while he was driving with a blood alcohol count of .12 percent.
