Guilty plea entered to felony DWI count
LOCKPORT — An Amherst man pleaded guilty Tuesday in Niagara County Court to a felony count of driving while intoxicated.
Jason C. Mesler, 23, of Tonawanda Creek Road, is scheduled to be sentenced Dec. 19 by Judge Matthew J. Murphy III. Deputy District Attorney Theodore A. Brenner recommended that Murphy give Mesler no more than six months in jail — the maximum is four years — but the judge made no commitment.
Mesler was pulled over Aug. 2 in the City of Lockport after failing to signal a turn and refused a breath test, Brenner said.
The guilty plea also takes care of Mesler’s arrest July 9 in Lockport on a charge of driving under the influence of drugs. Brenner told Murphy the evidence in that case was “relatively weak.” Mesler told a state trooper he had used marijuana and Xanax the day before, Brenner said.
