Approval withheld for patio homes in Lancaster

The Lancaster Town Board put a prominent local attorney’s patio home development project on ice Monday until he demonstrates more cooperation and consistency with the town’s approval process.

Councilwoman Donna G. Stempniak recommended that the board withhold approval for a revised map cover submitted by Jim Brown of Brown Chiari for Parkhaven, his two-phase, 60-unit patio home development being built along Bowen Road just south of Broadway in Lancaster.

Stempniak said Town Assessor David Marrano discovered discrepancies in comparing documents the developer had filed with Erie County and those Brown had filed with the town for approval.

For more than a year, she said, Brown also has refused to comply with town requirements for sidewalks within the patio home development.

“They’ve asked for a waiver. They can’t have a wavier,” Stempniak said flatly after Monday’s meeting.

In other business Monday, the board:

• Approved payment of $26,142, or half the salary and health insurance costs of a program coordinator for the Family Support Center of the Lancaster Central School District.

• Accepted a gift of $125,000 from Tops Markets to be used for costs associated with the construction of the Town Band Shell.

• Met in executive session at the meeting’s end to discuss what Supervisor Robert H. Giza said were contractual matters relating to the potential sale of the vacant Depew Library.

The structure, which has been empty for two years, has been a subject of political debate. Its potential uses are currently limited by zoning.
