A complicated dental insurance fraud case that took nearly five years to work its way through the federal courts is now back in court and headed for a possible retrial.

A grand jury has returned a 61- count indictment against Tejbir Oberoi, 65, of Kenmore, a former dentist, the U. S. Attorney’s Office reports.

Oberoi is accused of submitting false billings to insurance companies and government health care benefit programs for work that he never provided to patients in the 1990s.

Oberoi already has spent more than five years in federal prison after taking a plea deal to fraud charges in 2004. He left prison in 2008, but his conviction was vacated earlier this year because a federal appeals court ruled that he did not receive a speedy trial. The appeals court allowed federal prosecutors to charge him again, so the case has been refiled.
