Two sentenced to five years’ probation

LITTLE VALLEY — A Buffalo man who tried to sell crack cocaine in the City of Olean was one of two people sentenced Monday in Cattaraugus County Court.

Gabriel A. Harris, 22, was sentenced by Judge Larry M. Himelein to time served and five years’ probation, including 100 hours of community service, for his conviction of third-degree criminal sale of a controlled substance Oct. 4, 2007.

In the other case, Jason T. Ely, 34, of Delevan, was sentenced to five years’ probation and 100 hours of community service for his driving while intoxicated conviction. He was charged with driving drunk last Sept. 21 in Yorkshire.

District Attorney Edward M. Sharkey said others entered guilty pleas and will be sentenced in upcoming weeks.

Samantha Andress, 19, formerly of Elma, pleaded guilty to first-degree attempted robbery and second- degree burglary involving an incident Sept. 7 in the Town of Freedom, at a home where a weapon was used to try to commit a robbery.

Heather L. Blade, 33, of Olean, pleaded guilty to third-degree criminal sale of a controlled substance, crack cocaine, Sept. 17, in Olean.

Tara N. Gayton, 22, of Olean, pleaded guilty to fifth-degree criminal sale of a controlled substance, crack cocaine, Sept. 5 in the city.

Louis S. Mosher Jr., 25, of Kennedy, pleaded guilty to two counts each of third-degree burglary and fourth-degree criminal mischief and petit larceny between June 7 and Oct. 23, 2008, in the towns of Randolph and Napoli. He was accused of being involved in several burglaries in which property was damaged and items were stolen.

Matthew M. Dempsey, 31, of Hinsdale, pleaded guilty to DWI. He was driving drunk May 25 in the Olean and was driving with a blood-alcohol count of 0.20 percent, more than twice the legal limit.

Those pleading not guilty were: Ward C. John, 27, of Steamburg, to DWI. He is accused of driving drunk Jan. 17 in the City of Salamanca and with a blood-alcohol count of 0.23 percent.

Kevin L. Donaldson, 44, of Salamanca, pleaded not guilty to third-degree rape and endangering the welfare of a child Jan. 16 in the Salamanca, involving a person under age 17.

Donaldson is being held in the Niagara County Jail in Lockport on other federal sex charges for transporting a minor over state lines.
