Legislature race remains undecided

MAYVILLE—Control of the Chautauqua County Legislature hinges on the results of a razor-thin race that won’t be settled for at least another week, the county Board of Elections reported Monday.
Republican challenger Robert Stewart had a five-vote lead over Democratic Legislator Leon Beightol with 1,059 votes cast on Election Day in the 7th district, which covers Poland, Cherry Creek, Ellington and part of Charlotte.
Stewart’s lead shrank to one vote— 543 to 542—after affidavit and absentee ballots were added last week.
However, five ballots were not counted because of various concerns about their validity.
Stewart’s lawyers on Monday obtained a court order from State Supreme Court Justice Kevin M. Dillon that bars the board from counting the ballots until a hearing next Monday, said Brian Abram, the Republican elections commissioner.
This is the only undecided race among 25 county legislators.
There are 12 Republicans on one side and 10 Democrats, one Republican who caucuses with them and one Independence Party member who often votes with them on the other side.
