Husband, wife plead not guilty to fraud

LITTLE VALLEY — A husband and wife from Perry have entered pleas of not guilty in Cattaraugus County Court to insurance fraud and related charges involving a mobile home.
Ricky R. and Beth M. Kish, both 33, were arraigned Monday after a grand jury handed up charges of second-degree insurance fraud, making a punishable false written statement and third-degree falsely reporting an incident.
Both are accused of making false statements to sheriff’s deputies, allegedly saying a mobile home was damaged by fire, and attempting to make an insurance claim of more than $50,000 when the home had been sold.
Their crimes allegedly occurred between Aug. 6 and Sept. 24 in Cattaraugus County.
District Attorney Edward M. Sharkey said Judge Larry M. Himelein also sentenced several others to probation Monday:
David F. Cooper, 44, of Gowanda, was sentenced to five years’ probation and 220 hours of community service, and fined $2,000 for his conviction of driving while intoxicated and speeding Feb. 14 in the Town of New Albion.
Nadine M. Nudd, 37, of Cuba, was sentenced to five years’ probation and 200 hours of community service. She also must pay restitution after her conviction of first-degree falsifying business records and petit larceny March 2 in the City of Olean.
Sharkey said that while Nudd was employed as a teller at Community Bank, she created a bank statement that she purported to be from Five Star Bank and used it to steal money from a cash deposit.
Tara N. Gayton, 22, of Olean, was sentenced to five years’ probation and required to pay restitution after her conviction of fifth-degree criminal sale of a controlled substance, crack cocaine, Sept. 5, 2008, in the City of Olean.
Matthew M. Dempsey, 31, of Hinsdale, was sentenced to five years’ probation and 240 hours of community service, and fined $2,000 for his conviction of DWI May 25 in the City of Olean. While driving, he had a blood alcohol count of 0.20 percent.
Several others entered guilty pleas and have been scheduled for sentencing in January:
Raymond D. Neville, 17, of Randolph, who is being held in a secure facility, pleaded guilty to third-degree criminal mischief, first-degree riot and second-degree criminal trespass between May 31 and June 1 in the Town of Randolph. He damaged property at the Randolph Children’s Home.
Samantha J. Miller, 22, of Salamanca, pleaded guilty to third-degree attempted criminal sale of a controlled substance, crack cocaine, Jan. 8, 2008, in the City of Salamanca.
Paula J. Newell Barber, 35, of Randolph, pleaded guilty to DWI in two separate incidents: April 1 in the Town of Leon, and June 14 in the Town of Coldspring.
Traivel J. Daniels, 25, of Buffalo, pleaded guilty to fifth-degree criminal possession of a controlled substance, cocaine, March 27 in Olean.
Autumn M. Wheeler, 23, of Salamanca, pleaded guilty to third-degree attempted criminal sale of a controlled substance, crack cocaine, Jan. 24, 2008, in Salamanca.
