DEC closes probe into ammunition in landfill

WHEATFIELD — The state Department of Environmental Conservation announced Tuesday that it considers reports of old ammunition in fill used for a town drainage project “unsubstantiated” and is closing its investigation.

Complaints filed several weeks ago by opponents of former Supervisor Timothy E. Demler asserted that more than a decade ago, dirt used to cover up new pipes installed along residential backyards near The Summit mall contained bullets.

One worker, who insisted on anonymity when interviewed Tuesday by The Buffalo News, said he found two bullets and kept them in his home since 1998 or 1999.

The DEC said in a statement that those two rounds were 6 to 8 inches long and 1 to 3 inches thick, while the fill spread over the site by a private company hired by the town was no more than 2 inches thick. The DEC concluded that if any more bullets were there, they would have surfaced long ago.

The DEC statement said its Bureau of Environmental Crimes Investigation interviewed town and private workers and checked town documents.

“Considering the lack of evidence existing in support of this allegation, disrupting residences to remove soil based on an unsubstantiated claim does not appear justifiable,” the DEC statement said.

“There is evidence that the incident occurred 12 years ago,” Supervisor Robert B. Cliffe said. “Something would have happened [since then] if there was more in the ground. If something does happen, call the Sheriff’s Office.”
