Kincannon, two others arrested over fight

Jayvonna Kincannon, the former McKinley High student who became the center of a school disciplinary controversy a year and a half ago, was arrested Wednesday evening with two other women after an alleged fight with Buffalo police officers on the city’s East Side.

Kincannon, 19, of Wade Avenue, faces four counts of disorderly conduct, all violations, along with misdemeanor charges of obstructing governmental administration and resisting arrest.

According to police, Kincannon along with her grandmother, Marsha Jones, 54, also of Wade Street, and an aunt, Darlene Fitzgerald, 40, of Kensington Avenue, were apparently engaged in a family feud near Alma and Olympic avenues at about 5:30 p. m.

The dispute between families on Olympic and families on Alma escalated, and as many as 30-40 people spilled out into the street arguing, according to Michael J. DeGeorge, Buffalo police spokesman. That’s when somebody called 911 to report a fight.

When Northeast District Officer Kim Beaty arrived to investigate what was dispatched as a “neighbor dispute,” she instructed the large group to “calm down, go home and disperse,” according to DeGeorge.

“At some point, Jayvonna’s grand-

mother began using obscenities and she pushed Officer Beaty,” DeGeorge said. “Officer Beaty then tried to apprehend her, and that’s when [Kincannon’s] grandmother punched Officer Beaty in the chest area.”

“Apparently, Officer Beaty tried to get the grandmother into the police car and [Kincannon] punched Officer Beaty in the shoulder area,” DeGeorge said.

According to police, Fitzgerald also grabbed Beaty and pushed her.

At least 10 police cars from the Northeast and Ferry-Fillmore districts were called to deal with the fight, DeGeorge said. He said that Beaty was “pushed and punched a couple of times” but did not require medical attention.

“The officers certainly deserve credit for dispersing the crowd and getting this calmed down,” DeGeorge said.

Kincannon, while a senior at McKinley in 2007-08 was thrust into the center of turmoil in the Buffalo Public Schools after she reportedly denounced her principal, Crystal Barton, for firing volunteer assistant girls basketball coach, Michelle Stiles.

Kincannon was initially suspended from school for seven weeks. That was later reduced to five, but caused her to miss most of her senior basketball season and ignited a local media frenzy about the ordeal.

The suspension was later expunged from Kincannon’s official record by Superintendent James A. Williams upon the recommendation of a special investigator hired by the Board of Education.

The investigator found Kincannon’s suspension violated state education law as well as the board’s own policies, called the suspension “severe” and “excessive” and said it denied Kincannon “the minimum protections of due process.”

Kincannon graduated from the school and recently completed her first year at Genesee Community College, where she starred for the women’s basketball team and helped lead the school into the National Junior College Athletic Association’s Division II tournament.

Repeated attempts to reach Kincannon late Thursday for comment about her arrest were unsuccessful.

All three women were arraigned Thursday in Buffalo City Court.

Kincannon and Jones were released on their own recognizance. Fitzgerald was released after posting $2,500 bail.

All three have future dates scheduled in City Court.
