Angola woman admits driving while drugged with son in car

An Angola woman Tuesday became the second motorist in Erie County to plead guilty under a new state law on driving under the influence of drugs or alcohol with young children in the vehicle.

Kristen Allan, 34, of Wood Avenue, pleaded guilty before State Supreme Court Justice M. William Boller to a felony count of aggravated driving under the influence of drugs with her 3-year-old son in her car Jan. 12 in Lackawanna.

Boller ordered her to immediately sign up for treatment in Buffalo City Court’s Drug Court program for defendants with substance-abuse problems.

Putting off her sentencing to Aug. 27, the judge told Allan that if she completes the program, he will place her on five years’ probation. But citing previous driving and petit larceny arrests linked to her drug use, the judge warned her that she will be “facing some jail” if she flunks out of the Drug Court program or gets into any more trouble.

DWI Prosecutor Bethany A. Solek told the judge that Allan was illegally driving under the influence of a prescribed mood-controlling drug and morphine when she was stopped for driving erratically on Route 5 after striking a parked car in a gas station at about 7:30 p. m.

She was the second driver convicted in Erie County under Leandra’s Law.

On Friday, Jolie Nourse, 44, of Utica, was placed on five years’ probation by State Supreme Court Justice Penny M. Wolfgang on her Jan. 22 guilty plea to felony drunken driving with her four children in her car late Dec. 25 at the Thruway’s Williamsville toll barrier.

Boller allowed Allan to remain free on a previously posted $10,000 bail bond pending her sentencing. She declined comment after the court session.

Solek said Allan’s son is now living under court supervision with Allan’s mother.
