Bona players face charges stemming from late-night incident
Updated: August 21, 2010, 9:56 AM
Four St. Bonaventure men's basketball players have been arrested on violations, as a result of a March 21 fight between players for the Bonnies and a junior college team.
State police arrested the following St. Bonaventure players: Malcolm Eleby, 20, of
Philadelphia; Brett Roseboro, 18, of Allentown, Pa.; Da'Quan Cook, 22, of Elizabeth, N.J.; and
Lewis Leonard, 22, of Olean.
All four were charged with at least one count of second-degree harassment and disorderly
conduct, in connection with the fight that left two people stabbed, according to police
reports.
Violations, which are considered non-criminal and less serious than misdemeanors or
felonies, rarely lead to jail time, especially for first-time offenders.
"It's still an open investigation, and further arrests are pending," State Police Senior
Investigator Brian J. Ratajczak said today.
Ratajczak wouldn't say whether more people might be arrested or whether more charges are
pending against the four people already under arrest.
Law-enforcement officials also wouldn't say whether the case is expected to go to a
Cattaraugus County grand jury.
It also is not known what disciplinary action the college or the basketball team could take
against the four Bona players.
"We're glad that we seem to be coming to some resolution now," St. Bonaventure Athletic
Director Steve Watson said today. "[Coach Mark Schmidt] is on the road recruiting but we've
been in contact quite a bit and we're taking this very seriously. We have high expectations
for all of our student-athletes and we'll hold them accountable for their actions.
"In saying that, even though four of our student-athletes were issued a court summons after
being drawn into a fight on our campus, we're not going to proceed as a university or as an
athletic department until the legal process has concluded."
The two injured men have been identified as one current and one former member of the
Jamestown Community College-Olean team.
All four St. Bonaventure players were issued summonses and are scheduled to return to Town
of Allegany Court on Monday. Eleby and Leonard are juniors, Cook is a redshirt sophomore and Roseboro is a
freshman, according to the basketball roster on the university's athletic
Web site.
Attorney Brian O'Connell, who represents the players, said that the state police requested
he bring the players to the police barracks Thursday so they could receive their criminal
summons for the offenses.
"There were no formal arrests for any criminal charges with respect to this manner,"
O'Connell said. "These charges are violation level, they are not misdemeanor charges or
felonies and they are not considered crimes in the state of New York, they are violations."
The court appearance was set for April 12, but O'Connell wasn't available so the appearance
was adjourned to May 10.
"We're still investigating [the case] at this point and time," O'Connell said. ""We'll
appear on the 10th and maybe we'll have a resolution at that time but we're unsure at this
point."
State police previously said "about eight to 10" young men were involved in the fight,
which occurred at about 3 a.m. March 21 on the St. Bonaventure campus.
Rameek Boyd, 20, a freshman member of the JCC-Olean team, and James Chatmon, 20, a former
member of that team, were treated in Olean General Hospital for minor stab wounds and
released, police previously said.
Both young men were stabbed with a screwdriver, according to sources familiar with the
situation.
Sources previously have said the fight, on an early Sunday, stemmed from a Friday night
incident at the Rathskeller bar on the St. Bonaventure campus.
Several visitors from the junior college were ordered to leave the bar following a
disagreement between basketball players from the two schools. A group of Jamestown players and
friends then drove to St. Bonaventure early on the Sunday morning, pulled up outside some
townhouses where students lived and challenged members of the Bonaventure team to a fight,
sources have said.
"University officials and students are cooperating with New York State Police as they
investigate an altercation early Sunday morning between some SBU students and several men who
don't attend the university," a St. Bonaventure spokesman said in a statement the day after
the incident.
