Iranian native claims bridge harassment

Customs investigating Amherst driver's claim

Sherri Arbabzadeh, of Amherst, was entering the United States at the Rainbow Bridge in Niagara Falls last month when she handed the customs officer her passport.

He asked her what her citizenship was.

"Why are you asking me my citizenship when it's right there on my American passport?'" she responded.

From that point on, the 51-year-old naturalized U.S. citizen claims, she was harassed, searched and handcuffed.

Now federal officials are investigating the complaint of the Muslim-American businesswoman that she was mistreated.

Arbabzadeh claims she was the victim of racial profiling. She filed a formal complaint with U.S. Customs & Border Protection -- a division of the Department of Homeland Security -- and is awaiting a written response to her complaint.

"I am upset because I was treated like a criminal, and I think the only reason I was treated that way is that I am a person who was born in the Mideast," Arbabzadeh told The Buffalo News. "I did nothing illegal and nothing wrong. The only thing I did was ask a question."

The Amherst businesswoman was born in Iran but has been in the United States since 1979. She became a U.S. citizen 17 years ago.

In an interview, she alleged that she was mistreated when she returned to the United States after doing some shopping in Niagara Falls, Ont., on the evening of March 24.

"I handed my passport to the young officer in the booth, and he said, 'What is your citizenship?'" Arbabzadeh said. "I asked him, 'Why are you asking me my citizenship when it's right there on my American passport?'"

She said the officer then ordered her out of her car. She said she was surrounded by about four other officers, put into handcuffs and taken to an office for questioning.

She said she was released and allowed to drive home in her car about 90 minutes after her arrival at the customs booth. For more than a week after the incident, Arbabzadeh told The News, she had severe pain in her wrists and right hand, her back and her shoulder. She said the pain was making it difficult for her to sleep.

Customs officials filed no charges against Arbabzadeh.

Asked to comment on Arbabzadeh's allegations of racial profiling and rough treatment, Thomas J. Rusert, spokesman for the Buffalo field office of Customs & Border Protection, said, "We take these allegations seriously, and we are looking into Ms. Arbabzadeh's complaint. We do pride ourselves on our professionalism, and we expect our officers to treat returning U.S. citizens and visitors in a professional and courteous manner."

While declining to comment on specifics in the woman's complaint, Rusert said it is routine procedure for officers at the bridge to ask an individual his or her citizenship, even after a passport has been shown.

"We ask every traveler for a verbal declaration of their citizenship," he said. "It's a felony crime to falsely declare that you are a U.S. citizen."

Dr. Khalid Qazi, president of the Muslim Public Affairs Council of Western New York, said he is concerned about Arbabzadeh's complaint. He said she took the proper steps in filing a written complaint with the federal agency.

"We still hear complaints of this nature from people in our Muslim-American and Arab-American communities but not nearly as many as we had seven years ago," Qazi said. "The officer at the bridge certainly has the right to verify that a person is who she claims to be, but the fact that she was put into handcuffs is very unusual."

Qazi said he is making no judgments about the actions of the officers, because he was not there. He said his organization frequently talks and holds training sessions with law enforcement agencies in hopes of preventing "misunderstandings" between Muslim-Americans and police.

Arbabzadeh runs the New Image spa, an Amherst facility that provides Botox, laser hair removal and other anti-aging treatments.

Arbabzadeh said she supports the right of Homeland Security to protect America from terrorists "100 percent."

Since moving to Amherst from New York City about eight years ago, she said, her car has been searched at local bridges "at least five or six times ... sometimes by police dogs."

"I am a law-abiding citizen. ... I'm an American, and I love this country," she said. "All I want is to be treated fairly, like any other citizen in this country."

Sherri,
I'll express the same amount of sympathy to you that I would express to anyone else that went through something similar at the border of our country. "That sucks, but what can you do?" My comments earlier were not in relation to race or ethnicity at all. The simple fact is that in the current state of the world, harsher security is necessary to keep us safe. Being cuffed and questioned/interrogated at the border is a precaution. If there had been sexual harassment, assault and/or rape, that would be one thing, but these people were just doing their job. They can be harsh at times, but I would bet that it could have been much worse had you been entering a different country under the same circumstances.

Assuming that this has to do with race and then publicizing it just feeds into racist and prejudice propaganda... it doesn't help anything. I doubt that you are the only person that this has happened to, but because of your background it makes for a great article for the media. I'm not saying that you shouldn't have said something to someone, but feeding the press something that can be construed as racist just makes things worse...

To all my dear friends and fellow American Citizens,

As some of you may have already heard or took acknowledgement to my article that was published last month in the Buffalo News I say this. I oppose the acuracy not to mention it was very unprofessional in its sensitivity to the entire matter. Understandably the United States Customs and Border Protection is there to protect our great Country. To be somewhat portrayed as a possible criminal upon reentry into the US that is my home for simply questioning why I was being asked to reconfirm my citizenship then be interogated unfairly. The officer already had my Government issued US Passport in his hands for verification ! I'm not saying that all U.S. Customs employees are under misconduct but I am just insinuating the few that interagated me showed extreme unprofessionalism and this could have been dealt with in a more subtle and appropriate manner. I am speaking publically about my allegations to make the general public as a whole and my fellow US Citizens aware and to not allow this type of conduct or mistreatment to continue occuring. I sincerley hope that my ethnic background wasn't the solo reason for such a mishap.

Or just walk into Vermont or Maine? ...........Jeremy Lewis, FALSE again......I guess the fact that our land border crossings across the northern border with Canada seize $100 billion worth of illegal narcotics and goods every single year doesn't matter to you. Not to mention the thousands and thousands of wanted people and criminals who are apprehended at the land borders. Once again, you've figured it all out. Just walk your 100 tons of marijuana across the border. It's easy. Just ask Jeremy Lewis. You should quit while you're behind.....

Citing national security, U.S. State Department officials refused today to say how many American passports have been stolen or lost."................Don't worry, everyone. Jeremy Lewis, from Buffalo, NY, has this all figured out. He says that it's not a big issue...these passports are easy to spot....and everyone should be able to enter the USA without uttering a single word because their documents should speak for themselves....It's amazing that our Federal Government has entire divisions of investigators working on this issue, at a cost of billions of dollars, when all they had to do was call Jeremy for the solution.....

While you're at it, take your counterfeit US passport to Canada, turn around, and get in line to re-enter the USA. When the CBP Officer questions you, just don't say a word...and see what happens. After a few hours in custody, when you realize what a moron you are, perhaps they will release you so that you can hire the same ambulance-chaser that Miss Iran hired. After you spend all of the $25 you have in your bank account on the ambulance-chaser, only to have your complaints dismissed, maybe you'll finally realize what an idiot you truly are. Then come back on this website to complain about the "mistreatment", and what it's like to live under a Nazi regime. Meanwhile, the rest of us who know how to answer simple questions at an international border will pass through that border with expedited ease.

I think there's more to this story. Usually people who are detained at the border don't require 4 officers or handcuffs. Maybe her conduct after being asked to step out of the car was unruly!?!? Did her behavior warrant being handcuffed?? Maybe the News can follow up and get the details.

Why do you think that our Government puts 100 different security features into every single US passport, including watermarks and other distinguishing features that can only be seen under a UV light?

So that would mean that a forge passport would be pretty easy to spot, right? Stop reading these spy novels and watching 24.

The passports that were stolen a few years ago were BRITISH passports. Did she present a BRITISH passport?

I always get asked these questions. "How long were you in Canada?" And "Do you have anything to declare, are you bringing anything into the US."

If you have been in Canada for less than 24 hours there are different rules what you can bring in duty free. I've had to pull in and pay duty on hockey equipment before. I've also had to pay duty on beer, that I declared to customs when I entered the US.

And customs agents ARE looking to collect duty and stop smugglers, they are also trying to stop the illegal importation of certain items. You'd know this if you've ever traveled out of the US by aircraft of ship, you need to fill in a US Customs Declaration Form, BEFORE you arrive at the P.O.E. You have to list EVERY item bought out of the USA and the value and the customs agent will screen the form and collect any duty that is owed. I had to pay duty at JFK more than a few times. Even members of the US Armed Forces are subject to this requirement. A customs agent will board the aircraft when you land and no one gets off until he or she has screened the forms.

Ms. Arbabzadeh's unfortunate experience is a poignant example of post-9/11 Mccarthyist zeal to hunt down terrorists by erroneously targetting tax-paying, law-abiding, highly educated and affluent members of society who happen to have been born in the same region as a radical maniac who hijacked not only two planes but also the entire Muslim faith almost one decade ago. I know Ms. Arbabzadeh personally and she is perhaps the most patriotic person I've met as she is living proof of the American dream: a woman who dreamt big without any limitations of gender, race, or religion coupled with hard work who has made these dreams an actuality in the form of an incredibly successful and cutting edge business. Even more troublesome than the unsolicited assault against Ms. Arbabzadeh is the fact that so many people condone border patrol's unchecked and unwarranted power to treat contributing members of society like criminals because they are paradoxically "protecting American people" while stripping them of all their rights. I am appalled at the thought that border patrol's renegade witch hunt not only strong armed this mother of two, put her in handcuffs, questioned her for hours but also completely dessicrated the American dream she championed since moving to this country.

This woman wasn't discriminated against because she is from Iran. The CBP Officer wouldn't even know her country of origin unless he opened her passport and found that information on the inside page. All of this started before she had even handed him the passport. So everyone can stop agreeing with this idiot that she was discriminated against because she is from the Middle East..........Would everyone feel better if CBP stopped asking questions and just waved everyone through the border? Would that be in keeping with this desire to have "a safe and secure border"?? All this twit had to do was leave her attitude at home in Williamsville and answer a couple of routine questions. Maybe she would like it if we all went to her salon and acted like she did. Then we could go hire a lawyer and threaten a lawsuit. Despite her short time in this country, she seems to have learned an awful lot about our legal system. Be verbally abusive to the guys at the border, then hire an ambulance-chaser to get you a big payday so you can expand your nail polishing business.
