WHEATFIELD – The Town Board will hold a public hearing at 7 p.m. Monday on allowing lot sizes to be increased at a patio home subdivision off Sy Road.
The Wheatfield Lakes Patio Home Subdivision had 79 lots when the Town Board approved it in 2007.
Now, Town Engineer Timothy Zuber said, the developers, Ryan Homes, are asking to replace a planned 13-lot cul-de-sac near one of the artificial lakes with a string of four larger lots.
Also, changes might be allowed throughout the patio home subdivision.
Zuber said, “They wanted to change the lot areas and make them bigger, but they still have to meet the open space requirement.”
Wheatfield Lakes was approved as a planned unit development, and the town code says that such developments must have at least 25 percent of their area as open space.
Patio homes are smaller than typical single-family housing.
“It was originally done as a traditional patio home (development), and then they changed the format,” Town Attorney Robert J. O’Toole said.
“Now everybody wants a year to put in a fence and a deck,” Zuber said.
He said if Ryan Homes can’t make the 25 percent green space requirement with the enlarged lots, the permission to enlarge them won’t be approved.
O’Toole said that’s because even if the backyards are as green as could be, they don’t count toward the 25 percent green space requirement if they are privately owned.
A Ryan Homes division head did not return a call seeking comment last week.
O’Toole said the state Department of Environmental Conservation and the U.S. Army Corps of Engineers have given their approval to a Ryan Homes proposal to cut a walking trail through a wetland.
That wetland, which is owned by the Wheatfield Lakes Homeowners Association, is counted toward the green space.
Supervisor Robert B. Cliffe said he expects a lengthy hearing Monday because of local issues among the homeowners.
