The fiance of an Air National Guardsman who was the victim of a brutal attack in a University Heights bar is taking legal action to preserve evidence in the case.
Erika Webster, who is engaged to William C. Sager Jr. and is his guardian, filed preliminary paperwork in State Supreme Court in advance of a likely lawsuit against Molly’s Pub, principals with the bar and the City of Buffalo.
Sager remains in a coma at Erie County Medical Center following a fall down a flight of stairs at the Main Street bar on May 11.
Webster’s lawyer, Francis M. Letro, asks that all evidence, such as video footage from cell phones and surveillance cameras, as well as complaints, incident reports and 911 calls pertaining to Molly’s Pub from the last six months, be preserved and turned over.
Letro is also seeking the police investigation file on the case.
The information is sought in order to assist Webster in bringing a lawsuit, according to the paperwork, filed Friday. The filing names NHJB, Inc., the legal name for Molly’s Pub, as well as Norman J. Habib, Jeffrey J. Basil, Michael V. Miranda Jr., and the city. Habib holds the liquor license for Molly’s, while Basil is the bar manager. The paperwork did not identify Miranda.
Two off-duty police officers who had been working security outside the bar earlier in the night and later were inside the bar have been placed on paid administrative leave.
Basil, the bar manager, pleaded not guilty to a charge of first-degree assault.
The Buffalo Police Department’s Internal Affairs division and the FBI are investigating.
