The former owner of a Hamburg bar and restaurant must pay the state almost $73,000 in sales tax that he failed to pay for more than two years.

State Supreme Court Justice John L. Michalski on Tuesday ordered Luke Mumbach, 50, of Eden, to pay the state the $72,592 in sales tax payments that he missed between June 2009 and Aug. 31, 2011, when he operated the Buffalo Street Grill at 61 Buffalo St., Hamburg. The business has been under new ownership since July 2012.

The judge also sentenced Mumbach to a three-year adjournment in contemplation of dismissal, which means that the charges will be dismissed if he stays out of trouble for three years.

Mumbach pleaded guilty in July to second-degree grand larceny. He had faced a maximum prison sentence of five to 15 years, according to Erie County District Attorney Frank A. Sedita III.

Assistant District Attorney Gary M. Ertel prosecuted the case.
