WHEATFIELD – A Williamsville man with a history of drunken driving is facing new charges of driving while intoxicated after he was stopped by New York State Police on Monday on Niagara Falls Boulevard.

David M. Rust, 54, was additionally charged with moving from a lane unsafely and speeding.

Police said when they stopped Rust he appeared to be intoxicated and registered a blood alcohol level of 0.13 percent, which is above the legal limit of 0.08 percent.

He has a prior conviction for DWI within the past 10 years, making the new DWI charge a felony, according to police.
