A New Jersey motorist pulled over for failing to keep right while driving in Clarence was charged late Tuesday with a felony count of driving while intoxicated, the Erie County Sheriff’s Office reported this morning.
Jeffrey Martens, 42, was pulled over on Transit Road at about 11:30 p.m. Deputies said that after it was determined Martens was intoxicated, he was taken to the State Police barracks in Clarence, where a chemical breath test indicated he had a blood-alcohol content of .19.
A felony charged of aggravated DWI was lodged because Martens had a prior conviction in 2006 and his BAC exceeded .18, deputies said. He also was charged with unspecified violations of vehicle and traffic law.
Martens was taken to the county Holding Center pending arraignment in Clarence Town Court.
