A Depew man was charged with violating Leandra’s Law after a deputy discovered him impaired by drugs while he was driving with two children in his car, the Erie County Sheriff’s reported.
Deputy Simon Biegasiewicz responded to an accident involving two vehicles on Main Street at Sandridge Road in Alden about 8:45 p.m. Wednesday. During his investigation, the driver of one of the vehicles, David Wilczak, 30, admitted he had been using heroin that day, but he refused to submit to a blood test, according to Biegasiewicz.
Wilczak had two children, ages 5 and 9, in his vehicle at the time of the accident.
He was charged with driving while under the influence of drugs, two counts of endangering the welfare of a child and violating Leandra’s Law, the state statute that adds extra penalties for driving under the influence with passengers 15 or younger in the vehicle.
