NEWFANE – A man who was stopped for swerving all over the road told Niagara County sheriff’s deputies that he had two or three beers while doing yard work, but a check by deputies found his blood alcohol level close to twice the legal limit when he was stopped just after 8 p.m. Sunday in the 6200 block of Drake Settlement Road.

John F. Hensberry, 53, of Fuller Road, Burt, was charged with failure to stop for a stop sign, driving while intoxicated, driving on the shoulders of the road and was additionally charged with drinking alcohol in a motor vehicle after deputies found a can of beer in the back of his truck. His blood alcohol level of 0.14 percent was above the legal limit of .08 percent, deputies said.
