LOCKPORT – A North Tonawanda man was arraigned in Niagara County Court Wednesday on charges of aggravated and felony driving while intoxicated.
Kevin B. Penvose, 54, of Witmer Road, also was charged with failure to keep right after a minor accident in North Tonawanda March 14. Penvose’s blood alcohol content was measured at 0.24 percent, three times the legal limit for intoxication, Deputy District Attorney Theodore A. Brenner said.
In another case Wednesday, Thomas J. Tomasino, 36, of Webster, pleaded guilty to misdemeanor DWI and second-degree aggravated unlicensed operation. He refused the breath test after he was pulled over Feb. 15 on Route 31 in Royalton. Judge Sara Sheldon Farkas scheduled sentencing Oct. 1 for Tomasino, who also has a felony DWI charge pending in Monroe County.
