LOCKPORT – Niagara County Judge Sara Sheldon Farkas declared a hung jury shortly before 9 p.m. Monday in the case of a North Tonawanda man accused of molesting an adolescent girl over a two-year period.
Bradley K. McNamara, 39, of Division Street, will return to court Dec. 12 to discuss the next steps in his case.
After two days of deliberation, the jury of eight women and four men voted 10-2 to acquit McNamara of all charges. However, a unanimous vote was required.
The jury spent most of Monday afternoon listening to a complete re-reading of the testimony of the girl, now 14, but that failed to break a deadlock the jury had first reported Friday afternoon.
Robert Berkun represented McNamara, while Assistant District Attorney Robert A. Zucco was the prosecutor.
