LOCKPORT – State Supreme Court Justice Richard C. Kloch Sr. has given a Niagara Falls woman a year to prove that she shouldn’t go to prison again.

Second-time felon Dallas J. Porter, 28, of 20th Street, was granted the interim probation sentence Thursday for fifth-degree criminal possession of a controlled substance. She sold some of her Suboxone prescription Jan. 30 in the Falls.

She was sentenced in 2008 to 1 1/3 to four years in prison for stabbing a man in the thigh, rupturing his femoral artery, during an argument after a card game.

This time, Kloch said he was “skeptical” about not sending Porter to prison. Defense attorney Robert Viola said Porter is a single mother of two and also takes her elderly mother to dialysis treatments three times a week. Porter and her mother wept with relief when Kloch announced his decision.
