LOCKPORT – A Level 1 sex offender, on parole until December 2014 in a burglary case, was granted a three-year conditional discharge Tuesday on a guilty plea to violating terms of the Sex Offender Registration Act.

Joseph M. Higdon, 26, of Niagara Falls Boulevard, Niagara Falls, had admitted in March to a felony for using an assumed name to create a Facebook account in July 2012.

However, Niagara County Judge Matthew J. Murphy III said it would be a waste of resources to place Higdon on probation while he remains on parole for a 2008 conviction for third-degree burglary and fourth-degree grand larceny. Higdon went on the sex offender registry in 2006 for having sex with a 15-year-old girl. He pleaded guilty then to a reduced charge of attempted sexual misconduct.
