LOCKPORT – Frank M. Thomas, a Niagara Falls man facing felony drug and gun charges, was indicted Friday in connection with a burglary at an electronic cigarette store on Pine Avenue in the Falls.
Thomas, 33, of Memorial Parkway, pleaded not guilty to burglary, criminal mischief and grand larceny, all in the third degree, along with fifth-degree criminal possession of stolen property. A co-defendant, Darnell K. Davis. 19, of Pierce Avenue, has yet to be arraigned.
Deputy District Attorney Doreen M. Hoffmann said the men allegedly stole most of the merchandise at the store on the night of July 30-31 and listed it for sale on the craigslist website.
Thomas was arrested in a Valentine’s Day drug raid at his home, and pleaded not guilty July 18 to two counts of third-degree criminal possession of a controlled substance – .65 ounces of cocaine – and one count of second-degree criminal possession of a weapon, a loaded Colt .357 Magnum handgun. That meant he was out on bail when the burglary allegedly occurred. County Judge Sara Sheldon Farkas jailed him Friday in lieu of $5,000 bail.
