Dennis C. Jeffrey, 51, of Ashland Avenue, was charged with striking a man in the face with a golf club July 19 in an argument over a downed tree limb. Jeffrey testified that he punched the man, denying he used the golf club.
The jury in his trial failed to reach a verdict on a felony weapons charge May 21, when it split 11-1 in favor of conviction on that count while convicting him of third-degree assault. Thursday, Jeffrey accepted a plea offer to fourth-degree criminal possession of a weapon, another misdemeanor, with Niagara County Judge Matthew J. Murphy III committing to sentence him concurrently on that and on the assault count July 17.
The maximum sentence for each is one year. However, Jeffrey must remain behind bars for 20 months because his convictions constituted a parole violation on a 10-to-20-year sentence imposed on 1995 on two drug felonies and a stolen property charge.
