LOCKPORT – Stephen M. Niver of Niagara Falls pleaded guilty Thursday in State Supreme Court to having downloaded child pornography onto his PlayStation unit using its Internet access capability.

Assistant District Attorney Robert A. Zucco said the preindictment plea deal included an agreement not to prosecute Niver for any other contents of the PlayStation and a 32-gigabyte thumb drive.

Niver, 23, of Walnut Avenue, admitted to promotion of a sexual performance of a child as a sexually motivated felony. Justice Richard C. Kloch Sr. released Niver from jail, where he’d been for the last two months, but told him his actions between now and his Aug. 14 sentencing date “will pretty much determine your sentence.” The maximum is seven years in prison, but probation also is a possibility.

Kloch told Niver to get a job and enter sex offender counseling, avoid using synthetic marijuana and avoid contact with his infant son and the child’s mother.
