LOCKPORT – A former Lockport man, who was released from a North Carolina state prison Monday after serving eight years for a 2006 rape there, is being held without bail in Niagara County Jail to answer charges of violating his probation in a statutory rape case here.

John A. Szwalla, 30, pleaded guilty in 2002 to third-degree rape for having sex with a 15-year-old girl in Lockport on Feb. 21, 2002. He was 17 at the time.

Niagara County Judge Matthew J. Murphy III remanded him to jail Tuesday to await action on the probation violation. If Szwalla is convicted of that accusation, he could go to state prison for as long as four years.
