LOCKPORT – A Buffalo man will make his third trip to state prison for felony driving while intoxicated, Niagara County Judge Matthew J. Murphy III ordered Thursday.
Raymond Black Jr., 50, of East Utica Street, was sentenced to one to three years behind bars despite what Murphy acknowledged was an eloquent plea for probation from defense attorney Robert R. Fogg.
Fogg urged Murphy, “Take a chance. You won’t regret it.” “I’m not going to regret it, because I’m going to send him to state prison,” Murphy replied.
Black was driving a van that struck a tree on Lincoln Avenue in the Town of Lockport just before 5:30 p.m. Sept. 26 and left the scene.
Black, who has been arrested repeatedly for DWI since 1992, is awaiting sentencing in Erie County on another felony DWI charge, Fogg said.
