LOCKPORT – Niagara County Judge Sara Sheldon Farkas kicked an Amherst thief out the judicial diversion program of court-supervised drug treatment Thursday, and he now faces up to four years in prison when he returns to court Oct. 2.

Joseph W. Donner, 29, of Tonawanda Creek Road, had pleaded guilty April 1 to fourth-degree grand larceny for stealing a Town of Lockport woman’s credit card in April 2013.

Since his plea, Farkas said, Donner missed two drug court dates and multiple probation and counseling appointments.

The diversion news was better for Jessica R. Broughton, who was allowed by State Supreme Court Justice Richard C. Kloch Sr. to plead guilty to a reduced charge of seventh-degree criminal possession of a controlled substance after successfully completing the program. She will receive a non-jail sentence to be determined.

Broughton, 23, of Crosby Avenue, Lockport, pleaded guilty to a felony in February 2013 after police raided her home and found cocaine.
