BATAVIA – Mail-in votes have settled a close contest for a seat in the Genesee County Legislature, with longtime Legislator Edward DeJaneiro Jr. taking a 33-vote lead over former City Councilman F. Robert Bialkowski.

The 21-vote election night margin grew in this week’s count of absentee ballots by the Board of Elections. The final total was 405 for the only Democrat on the legislature to 372 for Republican Bialkowski.

Still uncertain is the race for LeRoy town justice. The write-in tally gives Democrat Michael T. Welsh a one-vote lead over the GOP’s Scott McCumiskey, 817-816. However, nine military ballots are due Monday, which could alter the result.

Welsh, a lawyer, is a former member of the County Legislature.
