Two pranksters accused of listening in, recording and selling a private phone conversation by former Buffalo Bills General Manager Buddy Nix will avoid federal prison.

Joshua Barber and Nicholas Kaiser, both 21 of Plymouth, Mass., resolved the criminal case against them – they had been charged with intercepting a wire communication between private parties and making a telephone call without disclosing their identity - by entering pre-trial diversion agreements.

Assistant U.S. Attorney Michael DiGiacomo said Barber and Kaiser intercepted a phone conversation between Nix and Tampa Bay Bucaneers General Manger Mark Dominik and then sold it for $150 to a national media outlet.

The diversion agreements, which require Barber and Kaiser to abide by certain conditions for the next 18 months, are the result of an FBI investigation.
