The state’s highest court has agreed to hear a lawsuit filed by 13 white Buffalo firefighters.
The Court of Appeals will hear arguments by lawyers for the city and the firefighters in Eugene Margerum, et. al., v. City of Buffalo, in which the firefighters argue that they were denied promotions on the basis of race.
The city and the firefighters have filed cross appeals.
The Appellate Division had lowered the amount each firefighter had won, and they are appealing that decision. The city is seeking to have the case dismissed.
A date for oral arguments has not been set, but they are expected to be heard in five or six months.
