A convicted burglar who shot at a man he believed had stolen his heroin stash but missed faces up to 15 years in prison after he pleaded guilty to first-degree attempted assault and second-degree criminal possession of a weapon.
Michael Frears, 20, of Barton Street, will be sentenced as a second felony offender Aug. 25 by State Supreme Court Justice John L. Michalski, according to Erie County District Attorney Frank A. Sedita III.
Prosecutors said Frears was sleeping March 25 at a relative’s apartment on Maryland Street when he awoke and noticed his stash was missing. He fired his revolver at the intended victim in the apartment building’s hallway but missed, prosecutors said.
He then fled the building but was caught by Buffalo Police Lt. Michael Delong and Officer Donna Donovan who found he was wanted for violating his parole in connection with a 2011 burglary conviction. according to prosecutors.
