STOCKTON – A 55-year-old Stockton man who was already the subject of two felony drunken driving arrest warrants was jailed without bail after Chautauqua County sheriff’s deputies captured him after he tried to flee Friday evening.

Timothy J. Banach was captured about 7 p.m. in a yard near his home on Cassadaga-Stockton Road. He had been spotted in the passenger seat of a car driving down Cassadaga-Stockton Road and ran when the vehicle was pulled over.

Banach refused to surrender until the sheriff’s K-9, “Drago,” was brought to the scene. He is being held at the county jail without bail pending court action on his two longstanding felony DWI cases.

The driver of the car was not charged, but Banach may face further charges.
