A Buffalo attorney pleaded guilty this week in Erie County Court to attempted fourth-degree grand larceny, a misdemeanor, for collecting state withholding taxes on his employees’ wages for four years but failing to pay the money to the state.
David J. Seeger, 57, who has a law office at 69 Delaware Ave., admitted that he attempted to steal $21,281 by failing to file the appropriate returns and pay those taxes for the years 2009 through 2012, according to the state Department of Taxation and Finance.
As part of his plea, he made full restitution to the state for the withholding taxes owed, the department said.
The defendant also pleaded guilty to fifth-degree criminal tax fraud, a misdemeanor, for failing to file his 2011 state personal income tax return.
Seeger faces up to one year in jail when he is sentenced Oct. 14 by Judge Thomas P. Franczyk.
The case was investigated by the Tax Department’s Criminal Investigations Division and prosecuted by the Erie County District Attorney’s Office.
