PENDLETON – The Pendleton Town Board this week approved a law restricting the application of sewage sludge and related byproducts on town land.
The law was a reaction to the controversy in Wheatfield over the farm field application of biosolids generated by Quasar Energy Group’s anaerobic digestion plantn. Milleville Brothers Farm holds a state permit allowing it to spread the byproduct on its fields, including some in Pendleton, as fertilizer.
The new Pendleton law sets up a permit process to apply the sludge and related products, with the Town Board holding the final say after a mandatory public hearing, Town Attorney Claude A. Joerg said.
The law also sets up a 2,000-foot buffer zone between homes and where the material can be spread, and a 1,000-foot buffer for the nearest water well or body of water. There also are limits on the amounts of chemicals in the material to be applied.
Joerg said the law includes s a $250 fine and civil penalties for violations.
