LOCKPORT – Instead of waiting for a judge’s permission to reindict Level 3 sex offender Sean M. Vickers, the Niagara County District Attorney’s Office went ahead and did so, it was disclosed in Niagara County Court Tuesday.
Vickers, 45, of Geneva, pleaded not guilty to a 16-count superseding indictment which includes slightly different charges than the 17-count version handed up in October. Both accuse him of repeated molestation of three boys in the Somerset and Middleport areas in 2012 and 2013, and both carry a maximum life prison sentence.
Last week, prosecutors said they wanted to obtain a new indictment. That was because of unspecified problems with the first round of grand jury testimony by two of the three alleged victims, Assistant District Attorney Robert A. Zucco said.
The new indictment accuses Vickers of seven counts of predatory sexual assault against a child, five counts of second-degree criminal sexual act and two counts each of first-degree criminal sexual act and first-degree sexual abuse.
County Judge Sara Sheldon Farkas said Vickers’ trial date remains Aug. 18.
Assistant Public Defender A. Joseph Catalano said he will file a motion objecting to alleged violations of Vickers’ speedy trial rights. Zucco said he doesn’t believe there were any violations.
